Ask The Expert Questioner: zzz Question: I am 68 years old Texas resident. I have a rollover IRA from my 403B, it is the only income and no other assets. I stopped paying the credit cards payment because I couldn't afford to pay when I retired due to health problems. Can the cerdit card garnish my IRA without filling bankruptcy. Thanks Answer: ZZZ, thanks for your question and sorry it took me a little time to answer. Unfortunately, I am in Florida not in Texas. IRA's and other qualified assets are creditor protected in Florida, however, I am not certain of other states when it comes to creditor protection. I would advise that you contact an estate planning or bankruptcy attorney in your state.
